Terms and Conditions of Sale

1. The seller

Products purchased on the online shop available at shop.hmble.it (the "Shop") are sold by:

2. Scope

These terms govern the distance selling of the products offered on the Shop to consumers, pursuant to Italian Legislative Decree 206/2005 (the "Consumer Code") and Legislative Decree 70/2003. By placing an order you confirm that you have read and accepted these terms.

Sales are available for delivery in Italy, in Europe and in most countries worldwide, according to the destinations enabled at checkout and the rates indicated on the Shipping page.

3. Products and prices

All prices are in Euro and include VAT. Shipping costs are not included in the product price and are shown at checkout before order confirmation, according to the rates indicated on the Shipping page.

Product images are for illustration purposes: slight colour differences due to displays do not constitute a lack of conformity.

4. Conclusion of the contract

An order placed through the Shop constitutes a purchase offer. The contract is concluded when we send the order confirmation email. We reserve the right not to accept orders in the event of product unavailability, payment anomalies or incomplete data: in such cases any amount already charged will be fully refunded.

5. Pre-orders

For products marked as "pre-order", the estimated shipping date is indicated on the product page and in the confirmation email. Any significant changes to the shipping date will be communicated by email. If shipping is delayed by more than 30 days from the communicated date, you may cancel the order with a full refund.

6. Payments

We accept the payment methods shown at checkout (credit/debit cards via Shopify Payments, PayPal and the other available methods). The charge is made upon order confirmation. Payment data is handled securely and directly by the respective providers: we do not store full card details.

7. Shipping and delivery

We ship via express courier: GLS for Italy and FedEx for international destinations. Shipping costs depend on the destination country and the total weight of the order: rates for orders of up to 3 items are shown on the Shipping page; for larger orders the additional cost is calculated automatically based on weight. In any case, the exact amount is calculated and shown at checkout once the shipping address is entered, before order confirmation.

Indicative delivery times from the shipping date are: 4-7 days for Italy, 7-12 days for Europe, 14-20 days for the rest of the world.

Non-EU destinations: any customs duties, import taxes and clearance fees applied by the destination country (e.g. United Kingdom, Switzerland, Norway, United States) are not included in the price or in the shipping costs and are borne by the recipient.

Upon delivery, please check the integrity of the parcel and report any visible damage to the courier.

8. Right of withdrawal

You have the right to withdraw from the contract within 14 days of delivery, without giving any reason, pursuant to Articles 52 et seq. of the Consumer Code.

To exercise this right, send an explicit notice to shop@hmble.it within the deadline, indicating your order number. You must then return the products within 14 days of your notice, to the address we will provide. Return costs are borne by you.

Products must be returned intact, unused, unwashed and with their original labels. Only the handling necessary to establish the nature, characteristics and size of the product is permitted; any further use entails a diminished value for which you are liable.

The refund (including standard outbound shipping costs) will be issued within 14 days of your withdrawal notice, using the same payment method, and may be withheld until we receive the products or proof of their shipment.

Exclusion (Art. 59(c) of the Consumer Code): the right of withdrawal does not apply to personalized products, such as garments printed with a name chosen by the customer. Personalized products cannot be returned, except for lack of conformity.

9. Legal guarantee of conformity

All products are covered by the legal guarantee of conformity for 24 months from delivery (Articles 128 et seq. of the Consumer Code). In the event of a lack of conformity you are entitled to have conformity restored (replacement) or, where applicable, to a price reduction or termination of the contract. Report any defect to shop@hmble.it attaching photos and your order number.

10. Product personalization

For customizable products, the text you provide (e.g. the name on the jersey) is printed exactly as entered at the time of the order: please check the spelling carefully. We reserve the right to cancel, with a full refund, orders whose personalization contains content that is offensive, discriminatory, unlawful or infringing third-party rights (including trademarks and the names of well-known persons without authorization).

11. Liability

Nothing in these terms excludes or limits the seller's liability where it cannot be excluded or limited by law. In all other cases, the seller's liability is limited to the value of the order.

12. Intellectual property

The trademarks, logos, graphics and content on the Shop and on the products are owned by HMBLE S.r.l. or its licensors. The purchase of products does not transfer any intellectual property rights.

13. Governing law and jurisdiction

These terms are governed by Italian law. For consumers, the competent court is that of the consumer's place of residence or domicile. For buyers who do not qualify as consumers, the Court of Turin has exclusive jurisdiction.

14. Alternative dispute resolution

Consumers may resort to the alternative dispute resolution (ADR) procedures provided for by the Consumer Code, by contacting the competent ADR bodies. The right to bring proceedings before the ordinary courts remains unaffected.
